Will Hillary Be Indicted?

With the facts as we currently know them, it’s hard to see how Hillary is NOT indicted. Let’s first review those facts.

In 2008, Barack Obama defeated Hillary Clinton for the Democratic nomination for President of the United States. Then when Obama beat John McCain, one of his first major moves was to name Hillary Clinton as his Secretary of State. Then, contrary to existing federal regulation and law, Hillary set up a private email server in her home in Chappaqua, New York. She used this private email system, which was unsecure, for communicating official State Department business. Since it was unsecure, other governments, including those hostile to the United States, likely had access to this information, to the detriment of the United States.

When congressional committees began investigating the nature of these emails, Hillary Clinton deleted 32,000 of them, stating that they were all about yoga classes, or her daughter Chelsea’s wedding. When pressed, she first stated that none of them were classified. She later changed this story, saying that they weren’t marked as classified when she sent them. It has been revealed that 65 emails were considered “Secret”, and 22 were deemed “Top Secret.” It’s important to note that Hillary Clinton had signed a non-disclosure agreement in order to receive her security clearance in the first place, which required her to treat sensitive information as classified, even if it was not necessarily marked as such. So it certainly appears, at least on the surface, that Hillary has violated protocols, procedures, and the law. And by sending multiple Top Secret communications over an unsecured system, she has put U.S. national security at risk.

It’s important to also note that the very existence of the private email system which has gotten Hillary in such hot water, would not even have been discovered were it not for Trey Gowdy’s Select Committee on Benghazi. The Democrats, and much of the mainstream press, have poo-pooed the committee, and the results of its investigation thus far, but the email revelation could have an impact on the outcome of the upcoming presidential election.

So will Hillary be indicted?

The FBI confirmed, about two months ago, that it is indeed conducting an investigation relative to Hillary Clinton’s emails. The FBI is, however, keeping its cards pretty close to the vest. With this in mind, I thought I’d take advantage of FBI Director James Comey’s testifying before the House Judiciary Committee last month to press him a little on the investigation. Here’s what I asked Comey, and how he responded:

Me – “Is there anything that you can tell us as to when this matter might be wrapped up, one way or the other?”
Comey’s Response – “I can’t, Congressman, as you know we don’t talk about our investigations. What I can assure you is that I am very close personally to that investigation to ensure that we have the resources we need, including people and technology, and that it’s done the way the FBI tries to do all its work: independently, competently and promptly. That’s our goal, and I’m confident that it’s being done that way, but I can’t give you any more details beyond that.”

Now from everything I hear and know about James Comey, he’s a straight shooter. Even though he was appointed by Barack Obama to fill the job, he has an independent streak. (And like me, he happens to be a graduate of the College of William and Mary.) The bottom line is, I would expect him to let the evidence determine the outcome of the FBI probe, and with the damning evidence we already know about, I think that it is likely that the FBI will determine that there IS sufficient evidence to warrant criminal prosecution. (That being said, Charles Krauthammer and several other conservative commentators I respect were concerned with Barack Obama’s comments in a recent interview expressing confidence, and perhaps inside information, that the FBI investigation will decide not to recommend criminal prosecution.)

If the FBI does recommend criminal action, the matter would likely be referred to the Justice Department, where recent Obama appointee Attorney General Loretta Lynch would decide whether or not to prosecute Hillary. Her predecessor at the Justice Department, Eric Holder, so politicized the Department, that I worry this has seeped into the current Department headed by Ms. Lynch. Will a Democratic Attorney General, under a Democratic President, fairly and impartially prosecute the Democratic nominee for President, whatever the facts of the case may be?

I honestly don’t know. And neither does anybody else. Rumors I hear in Washington are that the FBI may well make their announcement in the next month or so. And if their recommendation is that Hillary’s actions warrant prosecution, this could be extremely damaging to her campaign, even if Loretta Lynch decides not to prosecute.

It could get very interesting.
